Eligibility: The NAPA’s VIP Race Fan Getaway to Dover Sweepstakes is open only to residents of the continental United States. Entrants must be eighteen (18) years of age or older, and possess a valid state issued drivers license at the time of entry.  Employees of the American Automobile Association, Inc (AAA), AAA’s affiliated motor clubs, National Automotive Parts Association, Michael Waltrip Racing, Retail Sports Marketing, as well as the immediate family (defined as spouses, children, parents and siblings) and household members of each such employee are not eligible.  Subject to all applicable federal, state, and local laws and regulations.

Entry & Selection of Potential Winners: There is one entry page that is accessible from either: www.napaonline.com/napasweeps or www.aaa.com/napasweeps.  Follow the instructions to enter the Sweepstakes.  Entries close at 11:59pm Eastern Daylight Time on 7/15/09.  One entry per e-mail address via this method of entry.  Should multiple users of the same email account enter the Sweepstakes and a dispute arises regarding the identity of the entrant, the authorized subscriber of the email account, at the time of entry, will be considered the entrant.  The definition of an account subscriber is the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address.  Any use of robotic, automatic, programmed or like means to enter the Sweepstakes online will void all such online entries affected by such methods.  Sponsor, American Automobile Association, Inc, AAA’s affiliated motor clubs,  Administrator and their agencies are not responsible for unauthorized human intervention, phone, technical, network, electronic, computer, hardware or software failures, malfunctions or disconnects of any kind, or misdirected, illegible, incomplete, stolen, garbled, fragmented or delayed internet/email computer transmissions or network/ISP/website internet accessibility/availability; or for incorrect or incomplete capture of any information.  All entries become the exclusive property of the Sponsor and will not be acknowledged.  No entries via automated computer programs permitted.   Only entries that have completed the required fields are eligible for the Grand Prize drawing.

By entering, you fully and unconditionally accept these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Potential winner will be selected in a random drawing from all eligible entries on or about July 31, 2009.  Except where prohibited, potential winner will be required to complete and return an affidavit of Eligibility and Liability/Publicity Release within five (5) days of being notified.  If the potential winner fails to sign, notarize and return the affidavit/release within the required time period, if he/she cannot be contacted within five (5) days of the first attempt to notify him/her, or if Sponsor determines in its sole discretion that he/she is ineligible, then he/she will forfeit the prize, and an alternate potential winner will be selected at random from among all remaining eligible entries.  Travel companions must sign and execute a Liability/Publicity Release prior to travel, except where prohibited. Travel companion must be 18 years of age or older. Prior to travel to the race event, the potential winner must provide a copy of a valid state issued identification card.  Winner will be required to provide social security numbers for tax reporting purposes.

Prizes: One (1) Grand Prize: Three day, two night trip to Dover, DE starting on September 26, 2009 and ending on September 28, 2009.  Trip includes:  Chance to meet Michael Waltrip in Dover on September 27, 2009, souvenir gift bag, roundtrip coach air transportation on a carrier of Sponsor’s choice between the major metropolitan airport near winner’s home (as determined by Sponsor in its sole discretion) and a Dover Area Airport, standard double occupancy accommodations for two (2) (one room) at a hotel of Sponsor’s choice and rental car of Sponsor’s choice.  Winner and travel companion must travel on same itinerary.  Approx. Retail Value: $2,000.00.  In the event that the actual value of the Grand Prize awarded is less than $2,000.00, the winner will not receive the balance in cash or otherwise.  Any expenses associated with Grand Prize receipt and/or use that are not expressly described in these Official Rules are the responsibility solely of the winner.  Such expenses may include but are not limited to federal, state and local taxes; meals; phone calls; and souvenirs.  Grand Prize is non-transferable.  No cash or other substitution permitted, except that Sponsor reserves the right to substitute the Grand Prize or a Grand Prize component of comparable or greater value at Sponsor’s sole discretion.  First Prize:  Win one (1) of Ten (10) autographed Michael Waltrip Racing #55 diecast cars (1:24 scale). Approx Retail Value $50.  Second Prize:  Win one (1) of Forty-Five (45) NAPA Racing caps.  Approx. Retail Value $20. Odds of winning any prize depend on the number of eligible entries received.

Publicity Release:  Except where prohibited, participation in the Promotion constitutes an entrant’s consent for Sponsor and its agents to use entrant’s name, likeness (including photograph), voice, opinions, biographical information and state/province of residence for promotional purposes in any media without further payment or consideration.

General Conditions:  In the event that the operation, security or administration of the Promotion is impaired in any way for any reason, Sponsor may, in its sole discretion, cancel, suspend and/or modify the Promotion.  Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the operation of the Promotion or to be acting in violation of these Official Rules or in a disruptive manner.  Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  In the event that an entrant’s entry is confirmed to have been erroneously lost, destroyed or deleted, entrant’s sole remedy shall be another entry into the Promotion.  If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

Release and Limitations of Liability:  By participating in the Promotion, entrants agree to release and hold harmless Sponsor, the American Automobile Association, Inc. (AAA), AAA’s affiliated motor clubs, National Automotive Parts Association, Michael Waltrip Racing, Retail Sports Marketing, each such company’s respective related companies, and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical or printing errors; (c) errors in the administration of the Promotion or the processing of entries; (d) late, lost, misdirected, damaged, incomplete, illegible or undeliverable entries or mail; or (e) injury or damage to persons or property, including but not limited to death, which may be  caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or receipt or use of any prize.  Entrants waive the right to claim any damages against the Released Parties whatsoever, including, without limitation, punitive, consequential or indirect damages.

Disputes: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out or connected with the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Atlanta, Georgia.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.
